By accessing or using our Service, you agree to be bound by these Terms. If you disagree with any part of the terms, then you may not access the Service.

2. IMPORTANT: Educational Use Only Disclaimer

MedAI is an educational tool designed for training and informational purposes only. The clinical cases, feedback, and all other content provided by our AI are generated for educational simulation and **are not a substitute for professional medical advice, diagnosis, or treatment.**

Never disregard professional medical advice or delay in seeking it because of something you have read on this Service. The Service is not intended for use in real-world patient diagnosis or management. We make no warranties about the accuracy, reliability, or completeness of the content provided. All liability with respect to actions taken or not taken based on the contents of this site are hereby expressly disclaimed.

3. Accounts

When you create an account with us, you must provide information that is accurate, complete, and current at all times. Failure to do so constitutes a breach of the Terms, which may result in immediate termination of your account on our Service.

You are responsible for safeguarding the password that you use to access the Service and for any activities or actions under your password. You agree not to disclose your password to any third party. You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.

4. Account Termination

We may terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms. Upon termination, your right to use the Service will immediately cease. If you wish to terminate your account, you may simply discontinue using the Service or contact us for assistance.

5. Credits and Subscriptions

Certain parts of the Service are billed on a subscription basis ("Pro Subscription") or through the purchase of credits ("Credit Bundles").

  • Free Tier: New users may be granted a limited number of free credits upon registration.
  • Credit Bundles: You may purchase packs of credits to generate additional cases. Purchased credits are added to your account upon successful payment and do not expire.
  • Pro Subscription: A monthly subscription grants you a set number of credits per month, along with access to premium features as described on our pricing page. Subscriptions will be billed on a recurring monthly basis.

All payments are handled through our third-party payment processor, Razorpay. By making a purchase, you agree to their terms and conditions.

6. Cancellation and Refunds

You may cancel your Pro Subscription at any time. The cancellation will take effect at the end of the current billing cycle, and you will not be charged for the subsequent month. Due to the digital nature of our service, all payments for Credit Bundles and Pro Subscriptions are **non-refundable**.

7. Intellectual Property

The Service and its original content (excluding content generated specifically for a user, such as case feedback), features, and functionality are and will remain the exclusive property of MedAI and its licensors. The case content generated by the AI for your use is licensed to you for personal, non-commercial, educational purposes only.

8. User Conduct

You agree not to use the Service:

  • In any way that violates any applicable national or international law or regulation.
  • To attempt to gain unauthorized access to, interfere with, damage, or disrupt any parts of the Service.
  • To engage in any other conduct that restricts or inhibits anyone's use or enjoyment of the Service.

We reserve the right to suspend or terminate the accounts of users who violate these rules.

9. Disclaimer of Warranties

Your use of the Service is at your sole risk. The Service is provided on an "AS IS" and "AS AVAILABLE" basis. The Service is provided without warranties of any kind, whether express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement or course of performance.

10. Limitation of Liability

In no event shall MedAI, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of or inability to access or use the Service.

11. Indemnification

You agree to defend, indemnify and hold harmless MedAI and its licensee and licensors, and their employees, contractors, agents, officers and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees), resulting from or arising out of your use and access of the Service, or a breach of these Terms.

12. Governing Law

These Terms shall be governed and construed in accordance with the laws of India, without regard to its conflict of law provisions. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

13. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. We will provide at least 30 days' notice prior to any new terms taking effect. By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms.
